NY Penal Law § 221.40: Criminal sale of marihuana in the fourth degree
There are 5 offenses in the New York Penal Code that make it illegal to sell marihuana. Like criminal sale of marihuana in the fifth degree, criminal sale of marihuana in the fourth degree is a misdemeanor. Under New York Penal code § 221.40, you will be charged with criminal sale of marihuana in the fourth degree if you sell 25 grams or less of marihuana. The exception to this rule is if you give away less than 2 ounce of marihuana or one marihuana cigarette.
ExampleThe police received a tip about a man selling marihuana on a street corner. The same man sold 2 baggies of marihuana to an undercover police officer in exchange for $20.00. The man was arrested and charged with criminal sale of marihuana in the fourth degree.
