In New York, the offense of Statutory Rape is covered in Article 130 of the New York Penal Law. What degree is committed depends on the age of the perpetrator and the age of the victim. Generally, if the perpetrator is over the age of 21 years old, and the victim is under 17 yrs, the crime would be considered Rape in the 3d degree.
