What Is Criminal Mischief in the Fourth Degree?

Criminal mischief in the fourth degree is a class A misdemeanor. It is commonly associated with vandalism. If convicted you could be sent to jail for up to a year. However, unless you have a prior criminal record, it is more likely that your sentence will not include incarceration. If you damage a vehicle of another person by breaking into it in order to steal property from it and within the prior 10 years you have been convicted of criminal mischief, then the charge will be criminal mischief in the second degree. Furthermore, if you do take property from the vehicle, in addition to being charged with criminal mischief, you will also face a larceny charge.

You will also face a third degree criminal mischief charge if you intentionally damage the property of another person and the damage exceeds $250. It is a class E felony. This means that you could be sentenced to a prison term of up to 4 years, a probation term of up to 5 years. You will also be ordered to pay for the damages that you caused.

What Is Criminal Mischief in the Second Degree?
