At the time of release, a NYC sex offender who is required to register, must do so with New York State's Division of Criminal Justice Services. Upon release from prison the department and the Criminal Court who sentenced the defendant, will set a hearing to determine the level the sex offender will be designated. This designation decides the length of time the sex offender will appear on the registry and if local notice can be given within the community that the sex offender resides in it. The Court will evaluate the facts and circumstances that surrounded the criminal case in determining the notice level. Some of the factors the Criminal Court will examine include: violence during the criminal act, the use of a weapon, the involvement of narcotics (drugs) or alcoholic beverages, the age(s) of the victim(s), and if any one was hurt.

There are 3 levels of designation for a convicted sex offender 1, 2 and 3.

The first level or level one is the lowest designation and represents that the Criminal Court feels that this offender has a low risk of being a repeat offender for the same type of sexual offense Another factor the Court considers in these matters is their a danger to the community. It is not uncommon for 2 people convicted of the same sex offense to be assigned different levels based on the surrounding circumstances

The second level or Level two represents that the Criminal Court feels that the offender has a moderate risk to be repeat offender for the same type of sexual offense.

The third and final risk level or level three is the highest risk of the convict being a repeat offender and there is a significant risk to public safety.

Additionally, the New York Criminal Courts will determine whether the convicted sex offender should have a designation of sexual predator, sexually violent offender or predicate sex offender. These designations can lengthen the amount of time that the offender must stay on the registry and can impose a life registration. (The shortest duration on the registry is 20 years for a level one offender.)
